Owner: Misty Robbins Photography (“Photographer,” “we,” “our,” or “us”)
Welcome to Misty Robbins Photography. By accessing our website, booking a session, or purchasing photography services, you agree to the following Terms of Service.
1. Use of Website
• You may browse this site, view galleries, and purchase photography services for lawful purposes only.
• You agree not to copy, distribute, screenshot, or misuse any content or images without written permission.
2. Intellectual Property
• All photographs, text, branding, and design elements on this website are the property of Misty Robbins Photography and are protected by copyright.
• Clients may be granted limited personal-use rights to their images through a separate service agreement.
3. Booking & Payments
• A non-refundable retainer is required to secure any session.
• The remaining balance must be paid by the date of the session.
• Payments are processed securely through third-party providers (such as Pixieset, PayPal, or Stripe). Misty Robbins Photography does not collect or store payment card details.
4. Cancellations & Rescheduling
• Retainers are non-refundable.
• Sessions may be rescheduled with at least 7 day's notice, subject to availability.
• Cancellations made without proper notice may result in forfeiture of all payments.
5. Service Delivery
• Edited images are delivered through an online gallery hosted by a third-party service (such as Pixieset).
• Clients are responsible for downloading and backing up images within the gallery’s availability period (6 months).
• Raw, unedited files are not provided.
6. Copyright & Usage Rights
• Misty Robbins Photography retains full copyright of all images.
• Clients are granted a personal use license to print, share, and enjoy their photos.
• Images may not be sold, altered, or used for commercial purposes without written consent.
• Photographer may use selected images for portfolio, marketing, or promotional purposes unless the client requests otherwise in writing before the session.
7. Third-Party Services
• Misty Robbins Photography may use trusted third-party platforms (e.g., Pixieset for galleries, Stripe/PayPal for payments).
• We are not responsible for outages, service interruptions, or technical issues caused by these platforms.
8. Liability
• While every effort is made to deliver high-quality service, Misty Robbins Photography is not liable for circumstances beyond control (weather, accidents, lateness, restrictions, equipment failure, or third-party service issues).
• Our liability is limited to the amount paid for the photography service.
9. Changes to Terms
We may update these Terms of Service at any time. Updated terms will be posted here with a new effective date.
